Customer Export Control & Dual Use Undertaking
By purchasing products and services (Products) from ChartWorld, the Customer acknowledges and agrees that the Products may be subject to Federal German, EU and US export controls and dual use laws, and the Customer undertakes to comply with all applicable laws and regulations in the use and dissemination of the Products, including without limitation all export laws and regulations of the US government.
The customer specifically undertakes that they will not disregard any embargo imposed or acknowledged by Federal Germany, the EU, the US or the United Nations and that the Customer will neither use the Products for human rights violations (i.e. torture, slavery) nor for the production of nuclear, chemical or biological weapons.
Where ChartWorld suspects or becomes aware of any violation of the above undertaking, ChartWorld will withdraw with immediate effect from any contract for the supply of Products, whereupon German Law, specifically excluding International Private Law and the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG), shall apply.
